Problems of Legal Regulation of the Participation of Legal Clinics in Providing Free Legal Aid

The article examines the problems of legal regulation of the participation of legal clinics in the provision of free legal aid in Ukraine. The current legislation is analyzed, in particular the provisions of the Laws of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on Simplifying Access to Free Legal Aid», «On Free Legal Aid» and «On Higher Education», as well as the Model Regulation on Legal Clinics. It is established that, despite the fact that legal clinics actually provide free primary legal aid, they are not included in the list of entities authorized to provide such aid as defined by the special law, which indicates a fragmented regulatory approach to determining their legal status.
The paper substantiates that legal clinics perform four interrelated functions: educational, social, legal awareness-raising, and the function of inter-institutional cooperation, among which the educational and social functions are of primary importance. It is proved that the existing legislative model constrains the implementation of the social function of legal clinics and limits their potential in ensuring access to legal aid. The traditional doctrinal understanding of the equivalence of the educational and social functions of legal clinics requires clarification. Although the training of future lawyers is an integral component of their activities, it is derivative of the main, system-forming purpose – ensuring access to free legal aid. It is precisely through the actual provision of such aid that the practical component of legal education is formed, and not vice versa.
Particular attention is paid to the analysis of the possibilities of cooperation between legal clinics and local self-government bodies. It is established that such interaction is predominantly contractual and unsystematic in nature and is not supported by proper regulatory framework. The expediency of transitioning to an institutionalized model of cooperation through legislative consolidation of forms and mechanisms of interaction is substantiated.
It is concluded that improving the legal status of legal clinics and their inclusion in the system of providers of free legal aid will contribute to increasing the accessibility of such aid, primarily for socially vulnerable groups.
