Legal regulation of internship in Ukraine

Abstract

The article is devoted to the analysis of the regulatory framework for internships in Ukraine. The analysis of the interpretation of the concept of “internship” in both dictionaries and regulatory legal acts regulating the procedure for internships for various categories of persons is made. It is established that the internship is not identical to the concept of “trial”, but provided that a person successfully completes the internship, a probationary period is not applied to him when they are hired in accordance with the legislation. The attention is focused on the fact that internships can be for different categories of persons, in particular for applicants for professional, specialized pre-higher, higher education who have received the appropriate degree of education and continue to receive education at the next level in order to gain experience and improve professional knowledge, for civil servants in order to increase the level of professional competence, for young people, i.e. persons aged 14 to 18, in order to familiarize themselves with the peculiarities of public service, receive recommendations based on the results of internships and create an appropriate personnel reserve. It has been established that the procedure for youth internships in order to familiarize themselves with public service is regulated by various by-laws, depending on the type of state body, despite the fact that the procedure for completing internships is similar. In addition, such a type of internship as internship in state bodies is considered, in particular for those applying for civil service, and internships that are a prerequisite for obtaining the right to engage in certain activities or hold certain positions, for example, internships for lawyers and prosecutors, are also mentioned. A separate type of the internship is the one of local government employees, the regulatory legal act regulating the procedure for its completion will come into force no earlier than six months from the date of termination or abolition of martial law. It has been analyzed that the internship, depending on its type, can be paid, unpaid, as well as one in which the position and salary at the main place of work are retained. It has been established that the internship period varies from one to six months.
