Public consultations as a form of stakeholder participation in law-making: effectiveness and implementation challenges

This article provides a comprehensive analysis of public consultations as a form of stakeholder participation in law-making. It examines theoretical approaches to understanding consultation procedures in the context of participatory and deliberative democracy, as well as their significance for ensuring the legitimacy, transparency and quality of regulatory and legal decisions. It is established that contemporary international standards, developed by the Organisation for Economic Co-operation and Development, the European Union and the United Nations system, regard public consultations as an important mechanism for engaging the public in the process of shaping public policy and law-making.
Particular attention is paid to an analysis of the Law of Ukraine ‘On Public Consultations’ of 20 June 2024 № 3841-IX and its relationship with the Law of Ukraine ‘On Law-Making Activities’. It has been established that the adoption of this Law marked an important stage in the institutionalisation of consultation procedures in Ukraine and created the regulatory framework for the development of open government and the enhancement of public participation in the law-making process. At the same time, a number of problems with legislative regulation have been identified, in particular the excessive number of exceptions to the scope of the Act, the optional nature of consultations on draft laws submitted by Members of the Ukrainian Parliament, insufficient detail in the requirements for consultation documents, limited feedback mechanisms, and the absence of effective institutional oversight.
The current practice of public consultation in Ukraine has been analysed, and it has been established that one of the key problems remains the formal nature of many consultation procedures and the insufficient impact of the proposals submitted on the content of legislative acts. The paper justifies the need to improve the legislative design of consultations, develop digital infrastructure, introduce differentiated consultation periods, enhance inclusivity, and implement deliberative forms of public participation.
