Legal framework for ensuring environmental policy and environmental security in the EU

Abstract

As stated in the Basic Principles (Strategy) of the State Environmental Policy of Ukraine for the period until 2030, the implementation of an ecosystem approach in sectoral policy and the improvement of the system of integrated environmental management, the integration of environmental policy into other policies, mandatory consideration of the environmental component during the development and approval of state planning documents is the path to a modern systemic environmental policy of the EU.
The purpose of the article is to study the legal foundations of ensuring environmental security in the EU through the prism of the principle of integration of environmental policy into other sectors of EU policies.
The article analyzes the fundamental provisions of the Treaty on the EU, the Treaty on the Functioning of the EU, the Charter of Fundamental Rights of the EU, the practice of the Court of Justice of the EU on the formation of the principles of EU environmental policy in the context of ensuring sustainable development, proving that these principles are binding only for EU institutions, Member States are obliged to comply with them only when implementing EU environmental stan¬dards, while retaining the right not to apply them in purely national matters.
The Environmental Action Programmes, which are advisory in nature and establish clear directions, objectives and principles of EU environmental policy with their detailed description and schedule for a certain period, were studied in retrospect, through the prism of the formation and development of the principle of integration of environmental policy into other sectors of EU policies. It has been proven that the principle of integration is crucial for integrating environmental protection into all sectors of EU policy, EU environmental policy is based on the principles of safety and preventive action; environmental safety in the EU is one of the goals of environmental policy and is achieved through the implementation of the principle of sustainable development.
As for Ukraine, the implementation of the principle of integration in the post-war period will play a special role, ensuring the reconstruction of the country in accordance with EU environmental standards, which will include the implementation of green recovery strategies that combine economic development with environmental protection, and the integration of environmental requirements into all national plans and programs, contributing to the sustainable development of the country.
