Критерії оцінки державної політики з точки зору міжнародного права прав людини

У роботі проаналізовано забезпечення прав людини в Україні за критеріями: наявність, доступність, прийнятність, адаптованість і якість, прояви дискримінації та використання усіх доступних засобів для повної реалізації прав та засобів правового захисту для розгляду ймовірних порушень. Проведено оцінювання досягнутих результатів на основі підходу, що передбачає використання індикаторів і орієнтирів прав людини, а також поєднання кількісного та якісного аналізу. Застосований підхід має чотири виміри: результати; політичні зусилля; ресурси; оцінки. Проаналізовано відповідальність держави як носія обов’язків за гарантування прав власникам прав шляхом прийняття справедливих законів, що мають юридичну силу, чесно і справедливо застосовуються як правоохоронними органами, так і судовою системою. Процеси політики оцінено за принципами участі, прозорості та підзвітності. Виявлено критичні прогалини у спроможності носія обов’язків, які майже завжди включають прогалини в правових, інституційних, політичних і бюджетних нормах, а також прогалини в знаннях про права людини, що стосуються як власників прав, так і носіїв обов’язків. Фіскальна та монетарна політика не орієнтовані на реалізацію всіх прав людини. Економічна політика держави орієнтована на ринкові регулятори за відсутності ринку. Зазначені недоліки не дають змоги мобілізувати максимум доступних ресурсів для забезпечення мінімального рівня економічних, соціальних і культурних прав. Регресивні заходи не ґрунтуються на прозорій та реальній участі зацікавлених сторін та не підлягають змістовним перевіркам і процедурам підзвітності, включаючи оцінку їх впливу на права людини.
