Legal clinic as an institution for forming the legal culture of society under martial law

The article investigates the role of legal clinics as an institutional mechanism for forming the legal culture of society under martial law in Ukraine. The theoretical and legal foundations of legal clinics’ functioning are analyzed, their legal education function and impact on the level of citizens’ legal consciousness are examined. The research explores the peculiarities of the transformation of legal education activities conducted by legal clinics under conditions of armed conflict, in particular: the expansion of target client groups, the introduction of remote and digital forms of work, and the increased public demand for legal assistance.
The article examines the structure of legal culture as an object of educational influence, with special emphasis on legal consciousness as its central element. It is argued that legal clinics exert a targeted influence on the formation of ordinary legal consciousness of citizens through three main mechanisms: direct legal counseling; conducting legal education events (lectures, seminars, online marathons, legal brochures); and indirect influence through the training of future lawyers who, in turn, disseminate legal culture in society.
A comparative legal analysis of the regulation of legal clinics’ activities in EU countries demonstrates that in European practice, legal clinics play a significant role in ensuring access to justice and raising the level of citizens’ legal awareness. The adaptation of EU best practices to Ukrainian realities is identified as a promising direction for strengthening the legal education function of legal clinics.
The study identifies the key problems that hinder the effective performance of the legal education function by legal clinics under martial law, namely: the absence of a clear legislative status for clinics as subjects of free legal aid; the lack of a special regulation for their operation under emergency and martial law; insufficient financial support; risks to information security in remote counseling; and the psychological state of student consultants themselves experiencing the consequences of hostilities.
Based on the analysis, the article formulates proposals for improving the legal regulation of legal clinics’ activities, including: enshrining the status of legal clinics as official subjects of primary free legal aid in the Law of Ukraine on Free Legal Aid; developing a special procedure for legal clinics’ activities under martial law; providing targeted budgetary funding for legal education programs in places of internally displaced persons’ residence; and incorporating legal education on military law, the rights of IDPs, and international humanitarian law into mandatory standards for legal clinics’ activities.
The research concludes that legal clinics, having proven their social effectiveness, have become key subjects of legal education in wartime conditions. Their further development requires appropriate legal support and institutional strengthening, which will contribute to raising the level of legal culture of Ukrainian society and strengthening its resilience in the conditions of armed conflict.
