Digitalization of Services in the Construction Sector: Legal and Organizational Aspects

Abstract

The article presents a comprehensive analysis of modern approaches to the digitalization of administrative services in the construction sector in Ukraine. The main focus is placed on the operation of the Unified State Electronic System in the Construction Sector (USESCS), which plays a key role in reforming the industry and ensuring transparency, efficiency, and the reduction of corruption risks. The article highlights the legal and regulatory foundations for the creation and use of the USESCS, particularly the provisions of the Resolution of the Cabinet of Ministers of Ukraine No. 681, which establishes the procedure for providing administrative services through the electronic system.
The principles of automatic provision of administrative services – without the involvement of officials – are examined, specifically in the context of registering notifications on the commencement of construction works and declarations of readiness of construction objects for operation, provided that the submitted data comply with legal requirements. Significant attention is given to the technical and organizational support of the system’s operation, including its structural components such as the Construction Activity Register, the electronic user account, the public portal, and other integrated resources.
The author provides a detailed analysis of the mechanisms for automatic information processing and verification based on risk assessment, the level of potential threat, and other criteria. The article also emphasizes the possibility of receiving services through the «Diia» portal or Administrative Service Centers (CNAPs), which expands citizens’ access to construction-related services.
Legal regulation adaptation to the needs of the digital environment is addressed, as well as the challenges associated with the implementation of digital technologies, particularly in terms of personal data protection, integration with other state systems, and improving digital literacy among participants in the construction process.
In conclusion, the article underscores that the implementation of automated procedures in urban planning is an essential step toward building an effective public governance model in the context of Ukraine’s post-war recovery.
